BackupSA Email Policy

This document details the Email policies and disclaimers for BackupSA. The details in this document relate to all Email communication transmitted by employees engaged in BackupSA business. All such electronic communication is hereafter referred to as “BackupSA Email.”

Confidentiality

BackupSA has provided secure encrypted Email systems for the transmission of sensitive information. Employees should use encrypted Email for information of a sensitive nature. Notwithstanding, the following applies to all company Email:
All communication is to be treated as confidential and the information in it may not be used or disclosed except for the purpose for which it has been sent. If you have reason to believe that you are not the intended recipient of this communication, please contact the sender immediately.

Copyright Infringement, Harassment and any other wrongful acts

The following applies to all Emails sent from a BackupSA Mailbox:
Employees of BackupSA are expressly required to not make any defamatory or harassing statements and not to infringe or authorise any infringement of copyright or any other legal right by Email communication. Any such communication is contrary to company policy and outside the scope of the employment of the individual concerned. The company will not accept any liability in respect of such a communication, and the employee responsible will be personally liable for any damages or other liability arising from this.

Forgery and Tampering by Third Parties

The following applies to all Emails sent from a BackupSA Mailbox:
Email can easily be forged or tampered with. BackupSA, and its employees accept no responsibility for Emails that have been forged or tampered with by any third party outside of BackupSA. *Interception of Email will be considered as tampering.

Disclaimer of Responsibility for transmission of Viruses and Malware

The following applies to all Emails sent from a BackupSA Mailbox:
Computer viruses can be transmitted by Email. The recipient should check this Email and any attachments for the presence of viruses. BackupSA accepts no liability for any damage caused by any virus, worm or trojan software transmitted by this Email. In the event of any unauthorised copying or forwarding, recipient will be required to indemnify BackupSA against any claim for loss or damage caused by any viruses or otherwise.

Privileged Legal Communications

If BackupSA Email is used for communicating with legal counsel, the following is applicable:
This communication is made for the purpose of obtaining legal advice or preparing for legal proceedings and legal privilege will be claimed accordingly.
