PRIVACY POLICY

1.         Compliance with applicable law: Protecting the privacy of end users of the Service (hereafter “Users”) is of utmost importance to My Personal Backup South Africa CC (hereafter "we" or "us" or “our” or “BackupSA”). BackupSA has accordingly developed this Privacy Policy in order to safeguard the User’s personal information and to protect the confidentiality thereof.  In so doing, BackupSA has paid particular attention to the Constitution of the Republic of South Africa Act, 108 of 1996, the Electronic Communications Act, 25 of 2002 and the Protection of Personal Information Bill of 2006 (currently before the South African Law Commission) and the common law so as to ensure compliance with all relevant statutory requirements and best practice under South African law.

2.         No liability for unauthorised disclosure: While BackupSA will do all things reasonably necessary to protect the User’s rights of privacy whilst on the Website, BackupSA cannot accept any liability whatsoever for unauthorised or unlawful disclosures of the User’s personal and confidential information made by third parties who are not subject to BackupSA’s control.

3.         Personal Information: For purposes of this Privacy Policy, “personal information” means the User’s information that is identifiable to the specific individual, or by which the specific individual can be identified, whether or not publicly available, such as or User’s name, surname, telephone number, cellphone number, physical address, company name and email address.

4.         Consent to collection: By Registering for the BackupSA Service, the User has consented to BackupSA’s collection of personal information on an ongoing basis for the continued duration of the User’s relationship with BackupSA, subject to the limitations set out in this Privacy Policy.

5.         Consent to transfer of personal information: The User furthermore consents to the transfer of any personal information outside the Republic of South Africa in order to give effect to the Service.

6.         Collection of personal information: The personal information collected by BackupSA is required for the purpose of rendering the Service to the User in terms of the Agreement between the Parties. Please note that BackupSA may collect certain information about your visit, such as the name of the Internet service provider and the Internet Protocol (IP) address through which you access the Internet; the date and time you access the Website; the pages that you access while at the Website and the Internet address of the website from which you linked directly to the Website. This information is used to help improve the Website, analyze trends, and administer the Website.

7.         Cookies: We use cooking technology which comprises tiny pieces of data or a small text file that is stored on your computer’s hard drive and which contains information about you, so that the next time you visit the Website, the cookie reminds us of who you are, enabling us to achieve our goal of providing a valuable online experience to you.  You are able to, however, disable this cookie technology in your Internet browser.

8.         User Data: The User Data collected by BackupSA is used solely in connection with granting the User access to the Software and Service and for purposes of monitoring the User’s use of the Website so as to limit or prevent breaches of the Security provisions of the Agreement.

9.         Disclosure of personal information:  BackupSA will not disclose any personal information collected from a User to any third parties, unless where we are required to do so by law, including applicable laws of the United States of America, for example the USA Patriot Act 2001.  We will also provide personal information to law enforcement authorities in response to subpoenas and other lawful requests.

10.      Retention of personal information: All personal information will only be retained for as long as it is necessary to fulfil the purposes mentioned in clause 5 above.

11.      Accurate and up to date: BackupSA will not update any personal information from Users. Users have the obligation to keep personal information as accurate, complete and up to date as is necessary for the purposes mentioned in clause 5 above, and BackupSA may, from time to time request the User to update its personal information on the Website.

12.      Security: All personal information will be stored on BackupSA’s own server. Access to the server will be limited to BackupSA’s management personnel.

13.      Changes to this policy: We may need to change this policy from time to time in order to address new issues and reflect changes on our site. We will post those changes here so that you  will  always  know  what  information we  gather,  how  we  might  use that information, and  whether we  will disclose  that information  to anyone.
